Telecom officers given two weeks to choose employer

Get absorbed in BSNL or stay with Govt: High Court

NEW DELHI, APRIL 18: 

The Delhi High Court has asked Indian Telecom Service (ITS) Officers to decide whether they want to get absorbed in Bharat Sanchar Nigam Ltd or stay as Government employees. The court has set a two-week deadline for the ITS officers, who have been awaiting a resolution for over seven years.

The court has also told the Government to ensure redeployment of those officers who opt against getting absorbed in BSNL and not to keep them idle. The Bench has also directed BSNL to relieve remaining officers who do not opt for absorption within two weeks after the officers make their decision.

There are 1,700 ITS officers, of which about 90 have already opted to get absorbed in BSNL. Around 1,200 are working in BSNL on deputation, while 400 officers have been put in the surplus cell. The 400 ITS officers had filed the appeal in the court against the method adopted by the Department of Telecom in deciding the issue.

Responding to the High Court order the spokesperson of Indian Telecom Service Association said, “This is a big relief for us as this issue has been lingering for over seven years now. It has been decided that all the absorption offers made so far from retrospective date of October 1, 2000 are illegal which vindicates our stand in the matter and proves that Absorption Cell of DoT has all along been unreasonable, coercive and offered illegal absorption which officers did not accept. Officers are now preparing to comply with the two- week deadline of giving final choice for absorption.”

While this puts to rest the ITS absorption issue, the court's ruling could put BSNL in a tough position especially if majority of the officers decide to stay with the Government.

Over 1,000 officers are on deputation to BSNL and are handling some crucial functions. These officers had not opted to get absorbed in BSNL due to difference in benefits compared to a Government office

Main Points of the judgment are as under

i) The deemed date of absorption of the petitioners fixed as 1.10.2000, is held to be illegal, being contrary to Rule 37-A (4) of CCS (Pension) Rules;

ii) The deemed date of permanent absorption of such of the petitioners who seek permanent absorption in BSNL/MTNL shall be 8.12.2005;

iii) The petitioners before this Court are given an option, to be exercised within two weeks from the date of this order, to revert to the Government or to seek permanent absorption in BSNL/MTNL as the case may be;

iv) Those Government servants who have already accepted permanent absorption w.e.f. 1.10.2000 will not be entitled to exercise a fresh option in terms of this order;

v) BSNL/MTNL shall relieve such of the petitioners, who opt to revert to Government service within 2 weeks of receipt of options from them;

vi) Such of the petitioners who opt to revert to the Government shall be appropriately redeployed by the Government in Government service through surplus cell of the Government. We have no doubt in our mind that the Government would not like to keep such of the petitioners who opt to revert to the Government idle and, subject to availability of the positions with it, give them such work as is deemed appropriate to be performed by them.

Sibal asks Kapil BSNL to submit plans to become profitable

NEW DELHI: Telecom Minister Kapil Sibal today asked loss-making BSNL to submit plans for five projects that will help the company turn profitable. 

"I have asked BSNL to submit plans for five projects in the next four to six weeks which will help the company to move towards profitability," Sibal told reporters in Faridabad. 

BSNL's losses have more than tripled to Rs 5,997 crore crore during 2010-11. The company had registered a net loss of Rs 1 ,823 crore during 2009-10. 

BSNL had reported the highest net profit of over Rs 10,000 crore in 2005-06 but since then its profits have been falling and reported first net loss in 2009-10. 

"Though BSNL has a net worth of Rs 86,000 crore, but it incurred a loss of 6,000 crore, that is something thats needs to be changed," Sibal said. 

In order to turn profitable, BSNL has prepared several plans which also include a voluntary retirement plan to employees. 

BSNL has been asked to submit plans relating to tower sharing, usage of land and infrastructure which are not is use among others. 

The state-run service provider has over 50,000 towers across India. BSNL has tower sharing pacts with many private telecom operators. 

BSNL also has huge land and network assets, which is one of the largest in the country. 

"In my terms, I want to see BSNL becoming a Navratna," Sibal said.

The Medical Allowance scheme was dispensed with arbitrarly by finance instead of Administrative branch without consulting the union. We have demanded in the meeting for restoration of scheme and suggested number of days for allowance can be reduced through mutual discussions as per corporate culture.
Therefore, we request you to please take steps for restoration of the Medical Allowance scheme.

Sir,
Kindly refer to our letters No. TF-13/3 dated 17.12.2011 and TF-10/3 dated 27.02.2012 regarding extension of 78.2% IDA fixation benefit to BSNL non-executive employees.
In course of scheduled meeting held on 12.12.2011, we had mentioned that there is heart burning amongst the employees on the issue as every PSU has extended the 78.2% IDA fixation benefit to employees as per Govt. of India orders. But the biggest PSU, BSNL, has denied the same to its workers. Keeping in view the financial condition of the company. We suggested to extend notional benefit and accruing arrears be paid as and when the financial condition improves. This proposal was made to obviate recurring losses to employees. There has been understanding in the meeting that the matter will be sent to Management Committee for reconsideration. In this context reference is invited to BSNL Letter No. BSNL/7-13/SR/2011 dated 13.12.2011. The delay in settlement of the matter is creating avoidable resentment and tension amongst the staff.
Therefore, it is urged that the steps be taken for settlement of the matter.

BSNL income down 8% to Rs 29,688 crore in 2010-11, loss at Rs 6,384 crore

Telecom Lead India: The State-run mobile service provider BSNL has posted 8 percent decrease in revenue to Rs 29,688 crore in 2010-11 against Rs 32,045 crore in the previous fiscal, according to results posted on BSNL's website.

Capital expenditure for cellular during the period was Rs. 8138 crore. 

The company's net loss has gone up to Rs 6,384 crore in 2010-11 from Rs 1,822 crore in 2009-10. Loss before tax was Rs 6,578 crore in 2010-11 as compared with Rs 2,197 crore. Decline in revenue and increasing expenditure resulted in losses for BSNL.

Income from services was Rs 27,044 crore in 2010-11 against Rs 27,913 crore.

BSNL strategies to revive business

BSNL is taking several steps to reduce its losses and to improve its financial performance. The new steps include: optimizing CAPEX and OPEX through convergence and consolidation of infrastructure; strengthening of stable revenue streams through concerted focus on broadband and enterprise business with major focus on government projects; focusing on the revenue from top 100 cities for monitoring purpose; sustained operational focus on customer care, service delivery, service assurance, revenue management and asset management; aggressive push on data usage and value added services; clear cut segregation of commercial activities from social obligation to ensure sustainable growth and progressive migration of current network to next generation network thereby ensuring convergence, consolidation and seamless delivery of various services to end customers across different technologies.

TRAI recommends Rs 600 crore subsidy to BSNL

To revive the business of loss-making state owned telco, TRAI has recently recommended a subsidy of Rs 600 crore to BSNL, which would help the teleco in maintaining rural wireline connections installed before April 1, 2002.

In India, rural wireline subscription is constantly plunging. It dipped by 1 percent in January taking the total rural wireline base to 7.67 million, whereas rural wireless subscription is increasing at a healthy rate. In January, rural wireless subscriber base stood at 312.62 million at 1.64 percent monthly growth.

BSNL seeks TRAI support on 3G spectrum

BSNL has urged the Telecom Regulatory Authority of India (TRAI) to waive 3G spectrum usage charge for a few years in order to become more competitive in the market place.

BSNL suggested that the focus of TRAI should be to protect the interest of operators in addition to protecting the interest of consumers. Almost all operators are on the negative growth of profitability. The revenue accrued from 3G services is yet to match the cost of capital of the 3G spectrum fees.

400 ITS OFFICERS -SURPLUS

The government is likely to declare some 400 officers in the telecom department as surplus following their refusal to consider re-employment in BSNL.

These Indian Telecom Service executives, who had transferred to the DoT from cash-strapped BSNL in November, are likely to be moved to a surplus staffers cell in the HRD ministry, according to a senior official of BSNL.

"ITS officers without work will be moved to a surplus staff establishment, a unit of the department of personnel & training in the HRD ministry," the official said.
